WE reserve the right to respond to any request for service made by a customer and also reserve the right to block a customer or take appropriate legal action against the customer for making any obscene or profane remarks/requests.
WE do not endorse duplication, reproduction or copying of this site, in whole or part, for commercial purposes or otherwise, without the written consent of Essel Solutions.
WE are primarily involved in delivery of services and goods per customers' requests in Kolkata, India and its Suburbs. While we will make conscious effort to ensure that we deliver the best in good faith and without negligence, WE do not claim any right or representation of any of the brands that the customer may have ordered.
WE shall in no event be liable for inability/default under any applicable law(s), including those relating to Contract, Torts, Consumer Protection or any Civil or Criminal Laws, if it fails to provide the Services made available through THE WEBSITE due to any government restrictions or regulations or any unforeseen circumstances not within OUR reasonable control including strikes, war, natural calamities, acts of God or other events of force majeure.
In the rare event of non-delivery of a product or service, due to issues within OUR control, OUR liability shall be limited to the refund of the amount paid by the customer.
WE are not responsible for any errors, omissions or representations on any of our pages or on any links on any of our pages. WE do not endorse in any way, shape or form any advertisers on our web pages. Please verify the veracity of all information on your own before undertaking any reliance.
By placing an order on THE WEBSITE, the customer is authorizing the company to purchase the specific product/service in his/her name and/or on his/her behalf and is also authorizing the company to take all the necessary steps to enable the company to deliver the same to the beneficiary.
You are required to fill all details asked for in the order form so as to avoid an unnecessary delay. Every order placed by You shall be reviewed by US. Upon review and acceptance of the order by US, the order placed by You shall be confirmed and such confirmation shall be intimated to You through e-mail.
All information posted on THE WEBSITE, including but not limited to, the information, terms, conditions and descriptions that appear, are provided on an "AS IS" and "AS AVAILABLE" basis and are without any warranty or guarantee or undertaking by US.
At this time THE WEBSITE provides prices and quotations in Canadian Dollars only and accepts international credit cards only which will be charged to the customer through Paypal. WE do not store any credit card information on the site that may prove detrimental to the interest of the customer. Payment by Cash or Cheque is applicable to Customers who have placed at least 12 orders in the past 12 months and shall be solely at OUR discretion.
WE reserve the right to accept or refuse any request for cancellation of a service after the quotation has been accepted by the customer.
WE will only act as an .Order Booking Agent. and further facilitate the delivery of the products displayed on THE WEBSITE through various service providers (.Vendors.).
WE shall reserve the right to refuse delivery requests for Sundays & national/gazetted holidays or any other holiday declared by the government. We shall also reserve the right to refuse delivery to any address or location that WE may deem unapproachable, inaccessible or high risk. In such situation we shall provide you with a refund of an amount no more that the amount already paid for the requested service.
WE reserve the right to refuse or cancel orders at any time, including but not limited to orders that contain incorrect prices or product descriptions, orders in which WE believe that You have violated applicable law(s), and orders that WE believe are harmful to US and OUR affiliates. WE also reserve the right to limit the number of items purchased or ordered through THE WEBSITE. Delivery of the any product/good shall be as per the lead time reflected on THE WEBSITE, however delivery on the specified/requested date and time is not guaranteed but WE will employ its best effort for timely delivery. Urgent delivery is offered against limited products only mentioned on THE WEBSITE.
WE reserve the right to refuse or cancel any order placed for a product that is listed at an incorrect price and/or description. This shall be regardless of whether the order has been confirmed and/or payment been levied via credit card or cash or cheque. In the event the payment has been processed, the same shall be compensated to you by offering a re-purchase of any product/good of similar value or a refund shall be made for an amount no more than the amount paid for the service requested.
WE do not provide any separate warranty for products ordered. However, we will pass on any warranty cards that may be available with certain products, to the beneficiary at the time of delivery. The customer agrees that customer service issues regarding the item will be taken up with the manufacturer directly.
The delivery of gifts would be attempted only once. In case the delivery is not executed during the first attempt by US, due to wrong address/recipient not available/premises locked, You shall still be charged for the order. Also, refusal of any item by the recipient shall be considered to be a complete delivery and no refund shall be made. Any re-delivery attempts orders will be taken only on request and all extra cost incurred on account of same shall be to your account.
Any image of the product displayed on THE WEBSITE is indicative in nature and You/Beneficiary acknowledges and agrees that the actual product may vary in size, color, shape etc. The product specifications (weight, size, color etc.) mentioned in the photograph is only approximate and not exhaustive. WE expressly disclaim everything with regard to the fitness, potency, performance, after sales service and merchantability of the product and assumes absolutely no responsibility in this regard.
WE reserve the right to limit sales, including the right to prohibit sales to re-sellers. We are not responsible for typographical or photographic errors.
All prices and availability of products are subject to change without prior notice at OUR sole discretion.
Proof of delivery will be maintained by US for duration of 30 days from the date of delivery of the Service.
In case of deficiency in quality of the Service by the vendor/Service Provider, WE shall not be liable under any law, enactment etc & the service provider/vendor shall be liable for all costs, damages, fees etc. All grievances may be addressed directly to the Service Provider.
WE shall not be responsible in any manner whatsoever with regard to non-observance of the provisions of the Applicable laws by the Service provider /vendor including but not limited to the provisions of the Packaging Act, Weights & Measures Act and allied rules etc and the like.
Any request for cancellations, modification of orders once duly placed on the site or refund of the amount shall not be entertained.
WE respect each and every customer's privacy needs and do not share or intend to share any information regarding the customer or his/her beneficiary(ies) with any third party which includes the beneficiaries themselves. However, WE shall not have any non-disclosure agreement with our vendors and suppliers.
You shall be responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and You shall at all times assume all responsibility for all activities that occur under your account or password. Any damage, monetary or otherwise or any loss resulting due to misuse of your personal information shall be to your account and shall be borne exclusively by You.
Transmissions to or from THE WEBSITE may be intercepted and modified by third parties and hence files obtained from or through THE WEBSITE may contain computer viruses, spy ware or such other defects. WE shall not be responsible for any damage resulting out of such events and You shall defend, indemnify and hold US harmless against all claims in this regard.
WE will limit the collection and use of this information to what WE require to deliver superior service, which include administering our business and advising about products, services and other opportunities from US and OUR subsidiaries.
WE will permit only our alliance partners and vendors and our and their employees and other persons entitled to the information under this policy statement to have access to customer information. Our employees or our vendors' employees who violate our privacy policies will be subject to our normal disciplinary process. We will not reveal customer information to any external organization not authorized by this Privacy Statement unless we have previously informed you on THE WEBSITE or in agreements, or have been authorized by you, or are required by law.
Disputes, if any, related to www.caloddjobs.com, www.caloddjobs.ca or Essel Solutions shall be subject to the laws of Canada and subject to the jurisdiction within the City of Brampton, Ontario.
WE reserve the right to amend this agreement from time to time by changing the above mentioned terms and conditions. The terms and conditions applicable to the customer/visitor will be those prevailing on the day and time when you visit or use the site.

If you are dissatisfied at any stage with any portion of THE WEBSITE or with any of these terms of use, your sole and exclusive remedy is to discontinue using THE WEBSITE.
